澳洲留学签证之打工规定8105条款
持有学生 500 签证意味着您将自动获得打工的许可，但同时也受8105条款打工时间限制。

2023年7月1日起学生签证持有者的工作时间限制从covid前每两周工作40小时增加至每两周48小时。 -
在2023年12月31日之前，老年护理行业工作的国际学生工作时间不受限制。
遵守移民局对于留学生工作时间的规定非常重要，一旦违反留学生工作的规定，后果严重的话会被取消签证。下面澳凯将详细解读澳洲学生签证的打工限制条款8105。
一、什么是8105条款？
8105条款规定：
在课程开始之前不得在澳大利亚从事任何工作。
在课程期间的每两周，工作不得超过48 小时 。
但是，以下情况可以全职工作：
a. 学生在学校放假期间将没有时间限制
b. 当工作被指定为课程要求的一部分，包括实习（例如：厨师/幼教/养老护理等课程）
c. 就读研究型硕士学位 (Master degree by research) 或博士学位(Doctoral degree)
二、如何计算每两周48 小时？
例如，申请人的工作时间如下：
第 1 周：18 小时
第 2 周：30 小时
第 3 周：20 小时
第 4 周：28 小时
其中，第 2 周和第 3 周总工作时常超过48 小时，申请人将违反8105签证条款。
三、如何定义“工作”的范畴？
当然也有例外，比如所学课程所要求的工作不算。其次不拿报酬的志愿者工作。
如果符合下面三点条件，则不计算在每两周48小时的时长限制之中：
1.志愿者工作并非学生来澳的主要目的，只是偶尔参加。
2.这个志愿者工作因为某些原因不能由澳洲居民完成；
3.志愿者工作所服务的是一个非盈利组织，参与者不会得到包括现金在内的任何形式的物质回报。
四、什么时候可以打工？
移民局规定：拿学生签证来到澳洲境内之后，学习正式开始之前这段时间，是不能工作的。
比如，学校2月20日开学，1月拿到签证之后就买机票来了，想利用这段时间打工挣点生活费——这样的做法是违反8105条款。
五、假期工作有限制吗？
那么什么叫in session呢？简单来说，上课的时候肯定是in session。
那么小假期呢？比如，考试周的那一周假期呢？事实上夹在中间的考试周也属于in session。
只有暑寒假或者在完成整个课程之后，学生签证到期之前的这段时间，属于out of session，可以无限制工作。
一种特殊的情况是提前结束学业，而CoE上的毕业时间还没到。这时在移民局看来仍然算in session，如果打工时间超出规定，仍然算违反签证条款。
六、换签证怎么计算呢？
但是！如果完成了一个学位，又申请了下一个课程，并用下一个课程的CoE申请新的学生签证，那么在下一个课程正式开始之前，将不能工作。
例外：研究类课程不受时长限制。
研究类硕士以及所以博士生都不受上面所说的工作时长限制，但是同样要遵守“课程开始前不能工作”的 规定。
七、常见问题
可以。只要签证长度覆盖整个package课程，完成一个课程并等待新课程开始期间也可以全职工作。
Q:学生签证续签期间拿过桥签证可以工作吗？
两个学签衔接时持过桥签证期间可以工作，在新的学生签证批准之后新课程开始之前，不得工作。
Q:学生签证的副申请人可以在澳洲工作吗？
学生签证副申请人，在澳洲也具有和申请人一样的工作权力，受到8104条款限制。
Q:目前持有过桥签证，是否可以全职工作？
一般来说，过桥签证的打工限制与上一个签证的条款保持一致。但是对于申请了485工签和其他一些技术移民类别签证，一旦持有过桥A签证并已经生效，则打工时间就不再受限。这些类别包括：
